Terms for using PersonalHits.
Please read these Terms carefully—they explain what you can expect from us and what we expect from you when you use PersonalHits.

These Terms of Use (“Terms”) govern your access to and use of personalhits.com and related services (the “Services”) provided by PersonalHits (“PersonalHits,” “we,” “our,” or “us”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
We may update these Terms from time to time. If we make material changes, we’ll notify you via the site UI, a banner, pop-up, email, or other reasonable means, and update the “Last Modified” date. Your continued use after changes take effect constitutes acceptance.
1) Eligibility & Accounts
- Age: You must be at least 13 to use the Services. If you are under 18, you may use the Services only with the consent and supervision of a parent/guardian.
- Registration: Provide accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us of any unauthorized use at contact@personalhits.com
2) Description of the Services
The Services let you order and personalize songs, gift them to others, and share links or previews on social platforms.
- Lyrics are generated via the Gemini API.
- Music is generated via the Suno API.
- Visual and multimedia materials (such as AI-generated cover art, short video clips, and social sharing kits) may also be included in certain packages, generated via the Gemini API or other providers.
We integrate these technologies into a unified experience but do not control or alter the underlying AI models. We also do not claim ownership of outputs generated by these APIs; our role is to package and deliver them as part of your PersonalHits experience.
3) User Content & License to Us
- Ownership: You retain ownership of the text, messages, and other materials you submit (“User Content”).
- License to deliver your order: You grant PersonalHits a non-exclusive, worldwide, royalty-free license to host, process, reproduce, adapt, and deliver User Content solely to provide the Services (e.g., to create and deliver your song, visuals, support, and troubleshooting).
- Sensitive data: Do not include sensitive personal data (health, religion, politics). If you choose to include it, you do so at your own responsibility.
4) Generated Songs & Visuals: Use & Ownership
All generated outputs (songs, cover art, images, video materials, or other multimedia content) are provided for personal, non-commercial use only.
Examples of permitted use:
- Gifting a song or visuals to a friend, family member, or colleague.
- Sharing on your personal social media.
- Playing or displaying at private or internal events (e.g., birthdays, small office gatherings).
You may not resell, redistribute, publicly monetize, or otherwise commercially exploit songs or visual materials generated through the Services without a separate written license.
Attribution (optional but appreciated) when sharing publicly: “Made with PersonalHits”.
5) Sharing, Gifts & Social Platforms
- If you provide recipient details (e.g., name, email) you confirm you have permission to do so. We use recipient data only to deliver the gift.
- When you generate a public link or use share buttons, your content may be visible publicly under third-party platform terms. You are responsible for what you share and for complying with those platforms’ policies.
6) Acceptable Use (summary)
You may not: (i) break laws; (ii) infringe IP rights; (iii) upload illegal/harmful/obscene/defamatory/hate content; (iv) harass or harm others; (v) reverse-engineer, scrape, or attempt to bypass protections; (vi) use VPN/proxies to evade blocks; (vii) include sensitive personal data; (viii) commercially exploit songs or visuals without a license.
We may suspend/terminate for violations. (Full AUP in Section 16.)
7) Payments, Packages & Taxes
- You may purchase access to the Services through song-based packages or credit-based packages.
- The available tiers and prices are listed on our Pricing page, which forms part of these Terms by reference.
- Payments are processed by Stripe; you also agree to Stripe’s terms and privacy. Prices may change prospectively; taxes may apply per your location.
- All purchases are one-time, non-transferable, and credits may carry an expiration period specified at purchase.
8) Subscription Renewals & Cancellations
Our Services currently do not use auto-renewing subscriptions. All purchases are one-time and tied to the package or credits you select.
9) Free Trials
If we offer free trials now or in the future, details will be provided on the Pricing page.
10) Refund Policy
Personalized digital products are generally non-refundable once delivered. Refunds may be granted for:
(i) verified technical non-delivery;
(ii) duplicate charges;
(iii) irreparable file corruption.

Request within 7 days at contact@personalhits.com. Refunds are processed via Stripe and can take 5–10 business days.
Nothing in this section affects your statutory consumer rights under EU law.
11) Modifications to the Services
We may modify, suspend, or discontinue the Services (or any feature) with or without notice. We are not liable for such changes; we will refund any pre-paid, unused fees where required by law.
12) General Practices: Storage & Inactivity
We may set general practices and limits, including storage quotas, retention windows, and deactivation/deletion of inactive accounts after a reasonable period. We will act in line with our Privacy Notice and applicable laws.
13) Intellectual Property in the Services
The Services (software, design, UI, trademarks, logos, site content) are owned by PersonalHits or its licensors. Except for the limited licenses expressly granted to you, no rights are transferred.
14) Third-Party Services & Links
The Services may integrate or link to third-party logins, platforms, or tools. Their terms and privacy policies govern your use of those services. We are not responsible for third-party sites or services.
15) Disclaimers & Limitation of Liability
The Services and generated outputs (songs, visuals, or other content) are provided “as is” and “as available”. We do not warrant uninterrupted or error-free operation or any particular creative outcome.
To the maximum extent permitted by law, PersonalHits’ total liability for any claim is limited to the amount you paid in the 12 months before the claim.
Some jurisdictions provide you extra rights that prevail over this clause.
16) Acceptable Use Policy (Full Text)
- Permitted: personal, non-commercial use (gifts, personal social sharing, internal company events without resale).
- Prohibited: illegal content/uses; IP infringement; harassment/hate/obscenity; reverse-engineering/scraping/bypassing security; reselling/redistributing songs or visuals; submitting sensitive personal data; any commercial exploitation without a written license.
- Enforcement: We may suspend/terminate accounts and, if required by law, report serious violations.
17) Feedback
Any ideas, suggestions, or feedback you share with us may be used by PersonalHits without obligation to you.
18) Copyright / IP Complaints
If you believe something on our Services infringes your rights, notify contact@personalhits.com with:
(i) your contact details;
(ii) description of the work/rights;
(iii) the URL/location of the material;
(iv) a statement of good-faith belief;
(v) a statement of accuracy and authority.

We will review and act as appropriate under applicable laws, including the EU Copyright Directive and other relevant regulations.
19) Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless PersonalHits and its personnel from claims arising out of your:
(i) misuse of the Services;
(ii) User Content;
(iii) violation of these Terms or others’ rights.

20) User Disputes
You are solely responsible for interactions with other users and recipients. We may (but are not required to) get involved in disputes.
21) Export Controls & International Use
You are responsible for compliance with export, sanctions, and local laws that may apply to your use of the Services and any content.
22) Force Majeure
We are not liable for delays or failures due to events beyond our reasonable control (e.g., outages, natural disasters, war, epidemics, regulatory actions).
23) Termination
We may suspend or terminate accounts for violations, unlawful activity, or risk to others. You may request deletion at any time via contact@personalhits.com.
24) Governing Law & Venue
These Terms shall be governed by and construed in accordance with the laws of Ireland.
If you are a resident of the European Union, the mandatory consumer protection laws of your country of residence will also apply.
Any disputes will be subject to the exclusive jurisdiction of the courts of Dublin, Ireland.
